These SMS Terms and Conditions (“Terms”) govern your enrollment in and use of the text messaging program operated by Thompson Approach Academy LLC (“Company,” “we,” “us,” or “our”). By opting into our SMS program, you agree to these Terms in full.

These Terms constitute a legally binding agreement. Please read them carefully before opting in to receive SMS messages from us.

1. Program Description

Thompson Approach Academy LLC operates an SMS messaging program through which we send text messages to subscribers who have opted in. Messages may include:

• Inspirational and coaching content aligned with the 24 Hour Power™ framework • Announcements about new books, journals, and coaching products

• Event and seminar notifications

• Promotional offers and limited-time discounts

• Launch updates and pre-order information

• Responses to inbound text message inquiries

• Transactional messages related to purchases or registrations

2. Opt-In and Consent

A. How to Opt In

You may opt in to our SMS program by:

• Submitting your mobile phone number through our website opt-in form at

• Checking the SMS consent checkbox on any of our subscription or registration forms • Texting a designated keyword to our short code or long code number (when applicable)

By opting in, you expressly consent to receive recurring automated marketing and informational text messages from Thompson Approach Academy LLC at the mobile number you provide. You confirm that:

• You are the account holder or have permission from the account holder to opt in • You are at least 18 years of age

• The mobile number you provided is accurate and belongs to you

• You understand that consent is not required as a condition of purchasing any goods or services Consent to receive SMS messages is NOT required as a condition of any purchase.

3. Message Frequency

Message frequency varies. You may receive up to 4–8 messages per month depending on your subscription tier, active campaigns, and program activity. During special launch periods or events (such as the 24 Hour Power book launch), message frequency may temporarily increase. We will notify you in advance of any significant increase.

4. Message and Data Rates

Message and data rates may apply. Standard text messaging and data rates charged by your wireless carrier may apply to messages sent and received. Thompson Approach Academy LLC does not charge for SMS messages, but your carrier’s standard rates will apply. Contact your wireless carrier for details about your plan.

5. How to Opt Out

You may cancel your SMS subscription at any time. To opt out:

• Reply STOP to any text message you receive from us

• Reply QUIT, CANCEL, END, or UNSUBSCRIBE — all are accepted

• Email us at david@davidthompson.com and request removal

• Visit davidthompsoncoaching.com and use our contact form

After receiving your opt-out request, we will send one final confirmation message and then remove your number from our list. You will receive no further messages unless you re-subscribe.

To re-subscribe after opting out, text START to the number from which you previously received messages, or re-submit your number through our website opt-in form.

7. Supported Carriers

Our SMS program is supported by most major US wireless carriers, including but not limited to:

• T-Mobile

• Sprint

• U.S. Cellular

• Boost Mobile

• MetroPCS

• Cricket Wireless

Carrier support is not guaranteed for all carriers. Delivery of messages is subject to the policies and coverage of your individual wireless carrier. Thompson Approach Academy LLC is not liable for delayed or undelivered messages.

8. Data Privacy and Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be shared with any third party under any circumstances. Your mobile number is used solely for delivering the SMS communications you have consented to receive.

9. Prohibited Use

You agree not to use our SMS program in any manner that:

• Violates any applicable local, state, national, or international law or regulation

• Is fraudulent, deceptive, or misleading

• Infringes on any intellectual property rights

• Interferes with or disrupts the integrity of the messaging service

We reserve the right to terminate your access to our SMS program immediately and without notice if we determine, in our sole discretion, that you have violated these Terms.

10. Intellectual Property

All content delivered through our SMS program, including but not limited to text, frameworks, and branded terminology (including the Hand of Power™, 5 Arenas of Life™, 24 Hour Power™, and Thompson Approach™), is the intellectual property of Thompson Approach Academy LLC and David Wayne Thompson. Reproduction, redistribution, or commercial use of any content without written permission is strictly prohibited.

11. Disclaimer of Warranties

Our SMS program is provided “as is” and “as available” without warranties of any kind, either express or implied. Thompson Approach Academy LLC does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any errors or omissions in the content of our messages.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Thompson Approach Academy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use our SMS program, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Thompson Approach Academy LLC, its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of our SMS program, or your violation of these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes by sending an SMS message to enrolled subscribers and updating the “Last Updated” date above. Your continued participation in the SMS program after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should opt out of our SMS program.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

California Consumer Privacy Act (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including:

• The right to know what personal information we collect, use, disclose, and sell

• The right to request deletion of your personal information

• The right to opt out of the sale of your personal information (we do not sell personal information) • The right to non-discrimination for exercising your CCPA rights

To exercise your CCPA rights, contact us at david@davidthompson.com. We will respond to verifiable consumer requests within 45 days as required by California law.

California SMS Notice: California residents who opt in to SMS communications retain all rights under the CCPA. Your mobile number and SMS consent data will never be sold or shared with third parties for commercial purposes.
